If you are planning a project in or near water, you may be affecting fish habitat. Under the federal Fisheries Act, no one may carry out any work or undertaking that results in the harmful alteration, disruption, or destruction (HADD) of fish habitat, unless authorized by the Minister of Fisheries and Oceans Canada.
CLOCA has a level 3 agreement with the Department of Fisheries and Oceans (DFO), which means that the Authority screens and processes applications on behalf of DFO. During the review of a development or permit application, CLOCA staff may find that there is a possibility of a HADD.

CLOCA will either: 1) advise the applicant on how to avoid any damage to fish habitat; 2) advise the applicant on procedures for mitigating the impacts on fish habitat by redesigning the project to lessen the effects; or 3) prepare a compensation package which will require authorization from DFO.
Additional work permits may be required by the Authority or the Ministry of Natural Resources, depending upon the nature of the project. If your project is in or near water, begin by contacting CLOCA to determine what work permitting steps are required.
